What is repossession?

When you fall behind with mortgage repayments your lender can seize (repossess) your home. You are then evicted and the lender attempts to sell your home to pay off the outstanding debt.

How does home repossession work?

Generally your house will not be repossessed until 3 or more mortgage repayments are missed.

  1. Your lender will contact you with payment reminders
  2. If possible reach an agreement to repay the arrears while continuing to repay your mortgage.
  3. If you fail to agree a repayment structure your account is passed to the lenders solicitor.
  4. The solicitor will demand full payment and you will be warned of repossession.
  5. If you cannot make payment formal repossession proceedings normally start.
  6. A County Court hearing is set. It is in your best interests to attend the hearing.
  7. Before the County Court will even consider granting a possession order it first has to be satisfied that every avenue has been explored by the lender and borrower.
  8. A number of decisions are possible at this hearing:
    • Adjournment to a later date.
    • Case dismissed if you are able to pay arrears in full
    • Suspended order for repossession. If you are able to repay arrears a bit at a time and maintain monthly instalments, the repossession can be suspended.
    • It can grant an outright possession order. The lender can take possession of the property which will usually happen within 28 days.
  9. If you default after a suspended order or haven't vacated, you are served an eviction order. The court sets a time and date for you to vacate the property. A court representative along with a bailiff will then visit your property to take formal possession.
  10. Once the lender has vacant possession, the locks are changed, utilities disconnected, and the local police informed of the possession.

"Handing back the keys" is a myth. It will not stop repossession.

What are the consequences of being repossessed?

Lose Your Home
Obvious result of repossession but causes considerable emotional strain, loss of your main asset and forces you to find alternative accommodation.

Costs/Interest Charges
Housing minister Margaret Beckett recently suggested that the repossession costs the lender/you on average £35,000. The considerable penalty charges and costs associated with the repo are all added to your outstanding account.

Responsible for shortfall-
Often selling your home doesn’t clear the outstanding debt and you are liable for this. This may result in bailiffs attempting to recover other assets and could result in bankruptcy.

Normally home repossessions are put straight to house auction. Most homes sell for well under market value at auction, often up to 50%. Many properties do not sell and are put in future auctions at even lower prices.
